ROLEX WIN: Rolex Watch U.S.A. Inc. scored a judgment of nearly $160,000 and an injunction against two Web sites selling counterfeit Rolex timepieces Friday.
In January, Rolex filed a lawsuit against Gabriel Alvarez, operator of sites deviousdesires.net and deviousdesires.com, where it found counterfeit Rolex watches being sold for roughly $100 a piece.
According to Rolex, which purchased a few of the watches before filing the suit, Alvarez had advertised the Web sites via his Facebook and Twitter pages. The Web sites, which purported to sell luxury watches from the likes of Armani, Breitling, Bulgari, Cartier, Chanel, Gucci and Louis Vuitton, acknowledged on the site that the goods were knockoffs.
After Alvarez, who is based in San Jose, Calif., did not reply to Rolex’s complaint, Manhattan federal court Judge Laura Taylor Swain ruled in favor of Rolex, awarding the brand $140,000 in statutory damages and $16,701 in attorneys’ fees and other costs.
The judge said the offending Web sites’ domain names must be canceled or transferred to Rolex, and any goods bearing Rolex registered trademarks must be destroyed.
