Lane Bryant Inc. has been accused of infringing on Burlen Corp.'s lace designs. According to documents filed May 20 in federal court in Atlanta, Lane Bryant recently discontinued purchasing undergarments from Burlen, and without authorization, copied and produced replicas of the same undergarments, which include Burlen's copyrighted lace design. The defendant allegedly is marketing and selling these products in its retail stores and online. Burlen is asking for preliminary and injunctive relief, the impoundment and destruction of any infringing articles, unspecified financial damages and trial costs. Lane Bryant could not be reached for comment.
J.C. Penney Co. Inc. and several jewelry retailers have been accused of infringing on tungsten carbide jewelry ring patents owned by Trent West, a jewelry designer. According to documents filed May 29 in federal court in Dallas, West is suing Penney's, along with Samuels Jewelers Inc., Rogers Ltd. and Whitehall Jewelers Inc. He is asking for a preliminary and permanent injunction, unspecified financial damages and trial costs. The defendants could not be reached for comment.
QVC Inc. has been accused of infringing on the designs of Van Cleef & Arpels Inc. According to documents filed June 5 in Manhattan federal court, the home shopping retailer has sold jewelry products that infringe upon the Alhambra Quatrefoil Design Symbol, a trait of the jewelry house's 40-year-old Alhambra collection. Van Cleef & Arpels is seeking a permanent injunction against QVC for further sale of any of the infringing products. QVC did not return calls for comment.
A federal judge in Manhattan granted a preliminary injunction June 17 against further sale of the Vintage Alhambra Jewelry Design by New York-based Viccario Fine Jewelry and its suppliers, as the company also has been accused of infringing on Van Cleef & Arpels designs. According to court documents filed June 5, Viccario Fine Jewelry has manufactured and sold jewelry products that infringe upon Van Cleef & Arpels' Alhambra collection. Van Cleef & Arpels is seeking a permanent injunction against Viccario Fine Jewelry for further sale of the infringing products, the delivery of all existing infringing products for destruction, unspecified damages and trial costs.
